Emanuele Rossi, L’ambiente (e il resto) in Costituzione: fu vera gloria?

Abstract

Il saggio esamina le modifiche introdotte agli art. 9 e 41 della Costituzione italiana dalla legge costituzionale n. 1 del 2022, mettendo a fuoco il significato delle espressioni utilizzate e la loro possibile interpretazione. Il risultato complessivo dell’analisi è che l’intento perseguito dal legislatore costituzionale, ovvero di tutelare maggiormente l’ambiente, non sia stato realizzato in misura adeguata mediante la formulazione delle disposizioni introdotte.

Abstract (english)

The essay analyzes the reform of the art. 9 and 41 of the Italian Constitution by the constitutional law No. 1 of 2022, focusing on the meaning of the expressions used and their possible interpretation. The overall result of the analysis is that the intent pursued by the constitutional legislator, namely to better protect the environment, has not been adequately achieved through the formulation of the provisions introduced.
