Alessandro Chiessi, Post pandemia: quali criticità? Quali insegnamenti?

Abstract

Questo articolo muove dalla situazione post pandemica per cercare di analizzare le criticità di un’esperienza del recente passato, da cui muovere per trarre alcuni spunti di riflessione e auspicabilmente qualche insegnamento. Stemperata l’acribia del dibattito del momento, l’articolo adotta una duplice prospettiva – etica e giuridica – per mettere in mostra sia i principi prioritizzati nell’adozione dei provvedimenti al fine di contenere il contagio da Sars-Cov-2 o Covid-19, sia i risvolti inerenti alle stesse politiche positive introdotte durante il periodo pandemico.
Questa analisi, allora, vorrebbe mostrare quelle che sono state criticità e da qui muovere per tracciare un quadro che tenga insieme sia la dimensione teorica, sia quella pratica, nell’ottica di gestire future situazioni emergenziali. Se la diffusione del Covid-19 è alla base di provvedimenti eccezionali, l’auspicio di questa analisi è che questo evento abbia prodotto insegnamenti sia per i cittadini, sia per i decisori pubblici.

Abstract (english)

Starting from the post-pandemic situation, this paper analyzes the critical aspects of this event of the recent past, from which some considerations and, hopefully, lessons can be found. Softening the acrimony of the current debate, the paper adopts a dual perspective – ethical and legal – to show both the principles prioritized in the adoption of containment measures on Sars-Cov-2 or Covid-19 contagion, and the implications related to the policies introduced during the pandemic.
The aim of this analysis is therefore to identify the issues and, from there, to draw a picture bringing together both the theoretical and practical dimensions for preventing future emergencies. If the Covid-19 contagion is the root cause of exceptional measures, the hope of this research is that this event has produced teachings for both citizens and public decision-makers.
