N. Pedretti, Trasparenza integrale e pandemia

Abstract

L’epidemia causata dalla diffusione del Covid-19 ha cambiato profondamente il mondo rispetto a come lo conoscevamo. Il presente articolo intende affrontare, mediante l’esposizione di tesi della dottrina giuridica, il ruolo che può essere assunto dalla trasparenza integrale nel contribuire a un’efficiente gestione della pandemia, mediante una strategia volta alla cooperazione tra la popolazione e le pubbliche autorità. In Italia, le pubbliche amministrazioni sono sempre state piuttosto diffidenti verso la trasparenza e questo è stato confermato anche durante l’epidemia. Tuttavia, i recenti orientamenti giurisprudenziali e, parzialmente, le recenti scelte politiche sembrano affermare la centralità della trasparenza anche in periodi emergenziali.

Abstract (english)

The epidemic caused by the spread of Covid-19 has profoundly changed the world compared to how we know it. This article aims to examine, through the presentation of thesis of legal doctrine, the role that can be assumed by full transparency in contributing to an efficient management of the pandemic, through a strategy aimed at cooperation between the population and public authorities. In Italy, public administrations have always been rather wary of transparency and this was also confirmed during the epidemic. However, recent jurisprudential orientations and, partially, recent political choices seem to affirm the centrality of transparency even in emergency periods.
